Welcome to LitCheck ("LitCheck", "we", "us", or the "Company"). These Terms of Use ("Terms") govern your access to and use of the LitCheck mobile application (marketed as "Lit" and referred to in these Terms as the "App") and any associated websites, services, features, content and functionality offered by LitCheck (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Acceptance of Terms

• These Terms form a binding legal agreement between you and LitCheck.
• You represent and warrant that you have the legal capacity to enter into this agreement. If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization.
• The Service is not intended for use by children. If you are under the age required by applicable law to use the Service (including, where applicable, under 13), you may not use the Service.

2. Description of Service

• The App is a fashion-focused social networking application that enables users to showcase personal style, upload outfit photos, tag clothing items with shopping links, view and engage with a global feed of style inspiration, and participate in leaderboard-based gamification (weekly and monthly rankings, badges, and ranks).
• The App leverages cross-platform technologies and secure backend systems to provide the Service. The Service includes security features such as SSL pinning and device integrity checks intended to protect the App and its community.
• The Service is provided free of charge and, at the time these Terms are effective, does not include advertising, subscriptions, or paid features.

3. User Accounts & Registration

• Account creation: Certain features require you to create an account. You agree to provide accurate, current, and complete information when creating your account and to keep your account information up to date.
• Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or breach of account security.
• Eligibility: The Service is not for children. By registering, you confirm you meet the minimum age requirements under applicable law and are legally able to enter into these Terms.
• Multiple accounts: You may not create multiple accounts for deceptive purposes or to manipulate the Service (including leaderboards).

4. User Obligations & Acceptable Use

Acceptable use: You agree to use the Service only for lawful and authorized purposes and in a manner consistent with these Terms and any applicable community guidelines.

User-generated content (UGC): You may upload photos, captions, tags, comments and other content ("User Content"). By submitting User Content you represent and warrant that:

• You own or otherwise control all rights in and to the User Content and have the right to grant the rights granted in these Terms.
• The User Content does not violate any law, infringe any third-party rights (including intellectual property and privacy rights), or contain harmful, harassing, defamatory, obscene, or otherwise impermissible material.

Prohibited conduct. Without limitation, you may not:

• Post content that you do not have the right to post.
• Use the Service to harass, threaten, stalk, bully or harm others.
• Manipulate or exploit the leaderboard, badges, or rankings through fraudulent means, automation, or coordination with others to unfairly alter results.
• Use bots, scrapers, automated scripts, or other tools to access, collect, or manipulate data or content from the Service.
• Reverse-engineer, decompile, modify, or create derivative works of the App, or attempt to circumvent security or technical protections.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with the operation of the Service or servers, or attempt to gain unauthorized access to accounts, systems, or networks.

5. Intellectual Property Rights

Company IP: The App, its look and feel, software, design, graphics, logos, trade names, trademarks, and all content provided by LitCheck (other than User Content) are the exclusive property of LitCheck or its licensors and are protected by intellectual property laws. You may not use Company trademarks or logos without prior written permission.

License to User Content: By posting or uploading User Content to the Service you grant LitCheck a perpetual, non-exclusive, worldwide, royalty-free, transferable license to host, store, use, reproduce, modify, adapt, publicly display and distribute your User Content in connection with operating, promoting and improving the Service and developing new features, including in promotional materials. You may remove or delete content where the App provides that capability; however, copies may persist in backup and archival systems.

User rights: You retain all ownership rights in your User Content subject to the licenses granted to LitCheck and other users in connection with the Service.

6. Disclaimers & Limitation of Liability

No warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LITCHECK DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT.

No endorsement: The App may include content from other users or third parties. LitCheck does not endorse and is not responsible or liable for the accuracy, completeness, quality, legality, or reliability of any User Content or third-party content or services, including any shopping links users may include.

Security and privacy: While LitCheck implements security measures (including SSL pinning and device integrity checks), we cannot guarantee absolute security. You acknowledge that no online system is completely secure.

Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LITCHECK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION) ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE. LITCHECK'S AGGREGATE LIABILITY FOR CLAIMS UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

7. Subscriptions & Payments (if applicable)

• Current model: The Service is offered free of charge and does not require a paid subscription or in-app purchases at the Effective Date.
• Future changes: LitCheck may introduce paid features or subscriptions in the future. If we do, we will provide notice and additional terms regarding payment, renewal, cancellation and refunds at that time.
• Payment processing: If paid features are offered in the future, payments will be processed through the relevant app store or third-party processor and are subject to that processor's terms.

8. Termination

By you: You may terminate your account at any time by following the account deletion process in the App (Settings → "Hesabı Sil" / Delete Account). Upon termination, your access to the Service will end and your personal data will be deleted as described in our Privacy Policy and Account Deletion page.

By LitCheck: LitCheck may suspend or terminate your access and accounts, remove or disable content, or block devices without prior notice for conduct that violates these Terms, Community Guidelines, or applicable law, or for any reason in LitCheck's sole discretion.

Effect of termination: Termination does not relieve you of obligations incurred before termination. Sections that by their nature should survive termination (including Intellectual Property Rights, Disclaimers & Limitation of Liability, Indemnification, and Governing Law) will survive.

9. Governing Law

These Terms and any disputes arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

You and LitCheck agree to submit to the exclusive jurisdiction of the state and federal courts located in California for any disputes that are not subject to binding arbitration.

10. Changes to Terms

LitCheck may modify these Terms from time to time. We will post the revised Terms in the App and on our website and update the "Last Updated" and "Effective Date" at the top of these Terms.

Material changes: For material changes, we may provide additional notice (for example, via email or in-App notification) prior to the change taking effect.

Your continued use of the Service after the Effective Date of the modified Terms constitutes acceptance of the modified Terms.
